Welcome to Email Watch. These Terms of Service ("Terms") govern your use of our DMARC monitoring service. By using Email Watch, you agree to these Terms. Please read them carefully.

1. Service Description

Email Watch is a DMARC (Domain-based Message Authentication, Reporting, and Conformance) monitoring service designed for small and medium-sized businesses. We provide:

  • Automated collection and processing of DMARC aggregate reports
  • Real-time dashboards showing email authentication status
  • AI-powered analysis and recommendations (using Google Vertex AI)
  • Threat detection and security alerts
  • Historical reporting and trend analysis

2. Account Terms

Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. If you're using Email Watch on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Registration

  • You must provide accurate and complete information when creating your account
  • You are responsible for maintaining the security of your account password
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized access or security breach
  • One person or legal entity may maintain only one free account

Account Responsibilities

You agree to:

  • Provide accurate and up-to-date contact information
  • Keep your password secure and confidential
  • Not share your account with others
  • Not use Email Watch for any illegal or unauthorized purpose
  • Comply with all applicable laws and regulations

3. Subscription Plans and Billing

Free Trial

  • New accounts include a 14-day free trial of our Starter plan
  • No credit card is required for the trial
  • Trial accounts include all Starter plan features with up to 2 domains
  • At the end of the trial, your account will convert to a free tier with limited features unless you subscribe to a paid plan

Subscription Plans

We offer the following subscription plans:

Starter Plan - $19/month

  • Up to 2 monitored domains
  • Unlimited DMARC reports
  • AI-powered insights and recommendations
  • Real-time threat alerts via email
  • 30-day data retention
  • Email support

Professional Plan - $49/month

  • Up to 10 monitored domains
  • All Starter features
  • Advanced AI analysis
  • Priority email support
  • 90-day data retention
  • API access (coming soon)

Business Plan - $99/month

  • Up to 50 monitored domains
  • All Professional features
  • 1-year data retention
  • Priority support

Billing

  • Subscriptions are billed monthly in advance
  • Payment is processed securely through Stripe
  • All fees are in U.S. Dollars (USD)
  • Prices are subject to change with 30 days' notice
  • You authorize us to charge your payment method on file for all applicable fees

Refunds

  • We offer a 30-day money-back guarantee on your first paid subscription
  • Refund requests must be submitted within 30 days of your initial payment
  • After 30 days, fees are non-refundable
  • If you cancel mid-billing cycle, you retain access until the end of that period

Subscription Cancellation

You may cancel your paid subscription at any time from your account settings:

  • Cancellation takes effect at the end of your current billing period
  • You retain full access to your plan features until the period ends
  • No refunds are provided for partial months
  • After your subscription ends, your account remains active with limited free-tier access

Note: Subscription cancellation is different from account closure. Canceling your subscription keeps your account and data intact. See Section 13 for account closure.

4. Acceptable Use Policy

You agree not to use Email Watch to:

  • Monitor domains you don't own or have authorization to monitor
  • Violate any laws or regulations
  • Infringe on others' intellectual property rights
  • Send spam, phishing attempts, or malicious content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse engineer, decompile, or disassemble any part of our service
  • Use automated tools to access the service without our written permission
  • Interfere with or disrupt the service or servers
  • Resell or redistribute the service without authorization

5. Domain Verification and Monitoring

Domain Ownership

You represent and warrant that:

  • You own or have the legal right to monitor all domains you add to Email Watch
  • You have the authority to configure DNS records for your domains
  • You will not use Email Watch to monitor third-party domains without authorization

DMARC Configuration

  • You are responsible for configuring your DMARC DNS records to send reports to Email Watch
  • We provide guidance but are not responsible for your DNS configuration
  • Improper DMARC configuration may affect your email deliverability - use caution when setting enforcement policies

6. Data and Privacy

Your Data

  • You retain ownership of your domain data and DMARC reports
  • We process your data as described in our Privacy Policy
  • We use Google Vertex AI to analyze your data and provide insights
  • We retain DMARC reports based on your subscription plan (Starter: 30 days, Professional: 90 days, Business: 1 year), then automatically delete them

Data Security

We implement industry-standard security measures, but you acknowledge that:

  • No internet transmission is 100% secure
  • You use the service at your own risk
  • We are not liable for unauthorized access to your data due to circumstances beyond our reasonable control

7. Service Availability

Uptime

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • We may perform scheduled maintenance with advance notice when possible
  • We are not liable for service interruptions or downtime

Service Modifications

  • We may modify, suspend, or discontinue any part of the service at any time
  • We will provide reasonable notice of material changes
  • We are not liable for any modifications or discontinuation of service

8. Intellectual Property

Our Rights

Email Watch and all related content, features, and functionality are owned by Charles Green, LLC and protected by copyright, trademark, and other intellectual property laws.

License

We grant you a limited, non-exclusive, non-transferable license to access and use Email Watch for your internal business purposes, subject to these Terms.

Restrictions

You may not:

  • Copy, modify, or create derivative works of Email Watch
  • Reverse engineer or attempt to extract source code
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use our name, logo, or trademarks without written permission

9. Third-Party Services

Email Watch integrates with third-party services including:

  • Google Cloud Platform and Vertex AI
  • Stripe for payment processing
  • Brevo for email delivery
  • PostHog for analytics (optional)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

10. Disclaimer of Warranties

Email Watch is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of data
  • Uninterrupted or error-free operation

We do not warrant that Email Watch will prevent all email spoofing, phishing, or security threats. DMARC monitoring is a tool to help improve email security, but it does not guarantee complete protection.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHARLES GREEN, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Business interruption
  • Damages arising from your use or inability to use the service
  • Damages arising from unauthorized access to your data
  • Damages arising from third-party services

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Charles Green, LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of Email Watch
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of applicable laws or regulations

13. Termination and Account Closure

Subscription Cancellation vs. Account Closure

These are different actions with different consequences:

  • Subscription Cancellation: Stops future billing but keeps your account active with free-tier access. Your data remains intact.
  • Account Closure: Permanently closes your account and initiates data deletion. This cannot be undone after the grace period.

Account Closure by You

You may close your account at any time from your account settings. When you close your account:

  1. Immediate: Your account is deactivated and you cannot log in. Any active subscription is canceled.
  2. 30-Day Grace Period: Your data is retained but inaccessible. You may reactivate your account by contacting support@emailwatch.co within this period.
  3. After 30 Days: Your personal data is permanently and irreversibly deleted. See our Privacy Policy for details on what data is retained for legal compliance.

Data Export Before Closure

Before closing your account, you can export all your data from your account settings. We recommend downloading your data before initiating account closure, as data becomes inaccessible immediately upon closure. Export includes your profile, domain configurations, DMARC reports, and analysis history in JSON and CSV formats.

Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your payment fails and remains unresolved after multiple attempts and notifications
  • We are required to do so by law
  • We discontinue the service (with at least 30 days' notice)

If we terminate your account for reasons other than Terms violations, we will provide reasonable notice and allow you to export your data before termination.

Effect of Termination

  • Your access to Email Watch will cease immediately upon termination
  • Your data will be handled according to our Privacy Policy data retention schedule
  • You remain responsible for any outstanding fees incurred before termination
  • Provisions that should survive termination (indemnification, limitation of liability, intellectual property, governing law) will remain in effect

Refunds on Termination

  • If you close your account voluntarily, no refund is provided for unused subscription time
  • If we terminate your account for service discontinuation, you will receive a pro-rated refund for unused subscription time
  • If we terminate your account for Terms violations, no refund is provided

14. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Post the updated Terms on this page
  • Update the "Last updated" date at the top
  • Send you an email notification
  • Provide at least 30 days' notice before changes take effect

Your continued use of Email Watch after changes become effective constitutes acceptance of the updated Terms. If you don't agree to the changes, you must stop using the service and cancel your account.

15. Governing Law and Disputes

Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of Email Watch shall be resolved through:

  1. Informal Resolution: Contact us at support@emailwatch.co to attempt good-faith negotiation
  2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association's rules
  3. Jurisdiction: Any litigation will be conducted in Travis County, Texas

Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative proceedings.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Charles Green, LLC regarding Email Watch.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet/infrastructure failures.
